On August 7th, according to the Shanghai Municipal Cyberspace Administration, recently, after a review and inspection by the Shanghai Municipal Cyberspace Administration, it was found that Pacific Coffee, Luckin Coffee COSTA COFFEE、M Stand、 Six companies, including Novacoffee and One Foot Garden, still have inadequate rectification of problems, reflecting that some companies have not truly and effectively implemented the relevant requirements of the Personal Information Protection Law. On the afternoon of August 6th, the Shanghai Cyberspace Administration, in conjunction with the Municipal Market Supervision Bureau, lawfully held talks with the heads of the aforementioned coffee companies.
During the interview, the Shanghai Cyberspace Administration severely criticized six companies for their lack of privacy policies, untrue or incomplete information, forced or frequent inducement to collect accurate location information, forced or induced membership, and failure to provide targeted push closure and other illegal and irregular issues. It required companies to fulfill their personal information protection obligations seriously, fully implement the "minimum necessary" and "informed consent" principles of personal information processing, and truly achieve clear and complete privacy policies and legal and compliant collection of personal information. The Municipal Market Supervision Bureau requires enterprises to take effective measures to protect the legitimate rights and interests of consumers, implement the relevant requirements of the Consumer Rights and Interests Protection Law and the Implementation Regulations of the Consumer Rights and Interests Protection Law, fulfill the main responsibility of enterprises for protecting consumers' personal information, and effectively carry out lawful and standardized operations.
Officials from the Shanghai Cyberspace Administration and the Shanghai Market Supervision Bureau pointed out that "coffee culture" is the unique charm of Shanghai's international cultural metropolis, and coffee consumption demand has been widely integrated into people's work, life, study, leisure and other scenes in Shanghai. Amidst the fragrance of coffee, it is not only a feast for citizens' senses of smell and taste, but also an experience of safe, trustworthy, and reassuring consumption in the city. In response to the weak awareness of regulations, ineffective rectification of problems, and insufficient fulfillment of obligations in the field of personal information protection by some enterprises, the city and city level network information and market supervision departments will jointly organize on-site inspections of personal information protection "look back". For enterprises that repeatedly fail to reform and have serious problems, they will be filed for punishment and publicly exposed.
