On December 20th, Red Star Capital Bureau reported that Luckin Coffee (OTC: LKNCY) responded on its official Weibo account regarding the lawsuit and claim by Thailand's parent company, 50R Group, stating that the situation regarding the claim of 10 billion Thai baht (approximately RMB 2.046 billion) by Thailand's fake Luckin Coffee remains to be verified.
It is worth noting that this response is accompanied by a Thai sentence, with its translation in parentheses: I cannot understand, but I am greatly shocked!
According to reports from Thai media cited by China Overseas Chinese Network, multiple Thai media outlets reported that on the morning of December 19th, the Royal 50R Group of Thailand officially filed a lawsuit with the court, demanding that the court order China Luckin Coffee to compensate for economic losses of 10 billion Thai baht. The court has filed and accepted this case.
The Royal 50R Group of Thailand stated in the indictment that China Luckin had repeatedly forced it to stop using the trademark before the final judgment was made in court, and had repeatedly seized the other party's property, causing it to suffer serious economic losses. 50R Group also spent a lot of money on litigation, and demanded that the court order China Luckin to provide a total of 10 billion Thai baht in compensation.
After learning about the incident, a domestic lawyer told the Red Star Capital Bureau, "I am not familiar with Thai law, but this is indeed quite outrageous. China Luckin's alleged behavior is at most considered a preservation error in domestic litigation, and will not cause significant losses to the other party. In addition, there is insurance."
Previously, according to multiple media reports, China Luckin Coffee Company sued multiple defendants in Thailand in 2021 for trademark registration infringement, demanding the revocation of its trademark registration and requesting relevant parties to suspend the aforementioned trademark. On November 24, 2022, a Thai court issued a first instance judgment, ruling in favor of China Luckin Coffee Company and requesting the revocation of the relevant trademark registration, and ordering the two defendants to stop using the trademark. The defendant filed an appeal on March 24, 2023 and held another hearing on November 30, 2023, but the verdict on the appeal was not publicly announced in the Thai court system.
According to previous reports from Red Star News, on December 1st, the Central Court for Intellectual Property and International Trade in Thailand announced the final trial of the case of China Luckin Coffee Company accusing the Royal 50R Group of Thailand of trademark copyright infringement - China Luckin Coffee Company was ruled against and immediately executed.
