Tesla is about to fulfill its promise to deliver its long rumored electric truck Cybertruck in November. Its official website has also recently updated Tesla Motors' purchase agreement, which includes special regulations for Cyberrack.
Tesla's terms stipulate that as Cybertruck will initially be sold in limited quantities, buyers must promise not to resell the vehicle for a year after the delivery date.
This clause states that if the buyer has reason to sell the Cyberrack, Tesla may repurchase the vehicle at a lower depreciation price with Tesla's written consent. Depreciation is calculated at $0.25 per mile, plus wear and other necessary maintenance costs.
If Tesla chooses not to repurchase the vehicle, the buyer can resell it to a third party. But if the buyer resells the vehicle without Tesla's written consent, Tesla may take legal measures to prevent the transfer of ownership of the vehicle, and may also demand a penalty of $50000 or the buyer's transfer proceeds, whichever is higher.
Tesla also warned that if the buyer illegally transfers, Tesla may impose a future ban on the sale of its vehicles on the buyer.

At present, Tesla's official website has not disclosed details such as the price and delivery time of the Cybertruck, and buyers can only lock in the purchase of the electric truck by prepaying a deposit of $100.
Previously, Tesla had stated that the starting price of the truck was $39900, but later the company repeatedly hinted at high costs, which seemed to have been abandoned.
Tesla CEO Musk also revealed earlier that Cyberrack is highly expected to become a major cash flow contributor to Tesla within the next year to a year and a half. He also stated that he hopes to achieve an annual production of 250000 Cyberracks by 2025.
Although Cyberrack achieved delivery this year, it will not enter mass production until 2024. Therefore, early pre order data may become an important reference for Tesla's mass production.
These factors may be the main reasons driving Tesla to implement a non resale clause. As the only new model of Tesla in recent years, the Cybertruck is considered a disruptive product in the electric truck industry by the market. Coupled with limited quantity factors, this model is likely to be sold at a high price in the second-hand market, thereby affecting Tesla's mass production plan.
In addition, the prohibition of resale is relatively controllable during the execution process. Given that most of the software used by Tesla electric vehicles is subscription mode, the transfer of Tesla cars also involves the transfer of fully autonomous driving plans, which makes it easy for Tesla to monitor the occurrence of resale.
